What is a Special Declaration of Interest and why should I make one?

When traveling by air, you are protected under the Montreal Convention of 1999 and the EU Regulation 261/2004. These international regulations establish rules and practices which safeguard your rights.

The Montreal Convention sets out when the airline is liable to pay out for lost, damaged and delayed luggage, as well as what you as a passenger are entitled to in such an event. One question that every Lost & Found user is asked is whether you made a special declaration of interest in the delivery of your luggage. It’s unlikely you would have heard of this before, even many airline staff are unaware of what exactly a ‘special declaration’ is, but making one might not be a bad idea next time you fly with valuable items in your checked luggage.

A special declaration is simply telling the airline that your baggage exceeds the limit of liability they would have to you if something happens to your bag or the items inside it whilst in their charge. So in order to make a special declaration it’s important to know what those liability limits are.

For delayed, lost and damaged baggage passengers are entitled up to a limit of 1131 SDR and for luggage that has been delayed and damaged, passengers can claim up to 4694 SDR.

SDR stands for special drawing rights, and is foreign exchange reserve asset created by the IMF (International Monetary Fund). Its value is based on an artificial basket of currencies consisting of the US Dollar, the Euro, the British Pound and the Japanese Yen. On November 23rd 2016, the day this blog was posted, the value of one SDR was equal to 1.0918 GBP, 1.2766 Euros or 1.3535 US Dollars.

The liability limits laid down by the Montreal Convention are reviewed every five years.

It’s important to remember that an airline will not compensate for lost, delayed or damaged baggage, but they must refund passengers for items which are affected.
